Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of our Terms of Service. By using dicted you agree to follow it. Breaches of this AUP are grounds for throttling, suspension, or termination of your account — see Terms of Service §5 and §12.

1. What we are protecting against

Dicted is designed for interactive human use — a person dictating, transcribing meetings they attend, or running smart actions on text they authored or legitimately received. The categories below describe uses we do not permit, both to protect other users and the people recorded in content uploaded to the Service, and to protect our infrastructure.

2. You must not

2.1 Misuse the Service technically

  • Automated or scripted use. Do not pipe audio through the dictation pipeline programmatically, extract authentication credentials from our desktop client to call our backend directly, run our overlay headlessly, or otherwise use the Service other than as intended for interactive human use.
  • Carve-out: accessibility assistive technology (switch scanners, eye-trackers, voice-first OS layers) is welcome — if your use is adaptive but looks automated, contact [email protected] and we will whitelist your pattern.
  • Circumvent fair-use caps. Do not operate multiple free accounts to evade monthly limits, or use VPNs / geolocation spoofing to access the Service from excluded regions.
  • Share an account among multiple people. A Dicted account is licensed to a single individual. The concurrent-device limit on your plan is to let one person use Dicted across their own phone, laptop, and desktop — not to let two or more people share a single account. Specifically prohibited: sharing login credentials with anyone for any purpose; household, office, team, or organisation use on one paid account; reselling, sublicensing, or trading account access; and operating a "Dicted-as-a-service" intermediary that routes other people's audio or content through your subscription. If you need more than one user, each person needs their own account; for team or enterprise arrangements, contact [email protected].
  • Attempt to reverse-engineer our Service, decompile our client software, or extract credentials, except where expressly permitted by applicable law or the open-source licence of an individual component.
  • Probe, scan, or stress-test our infrastructure without a prior written coordinated-vulnerability-disclosure agreement.
  • Launch denial-of-service attacks or cause load that degrades the Service for other users.

2.2 Misuse the Service for content or other parties

  • Upload content without the rights to process it. You must have the right to record, upload, and transcribe any audio you send us — including the consent of any third parties whose voices appear, where your local law requires such consent. See Terms §6.4.
  • Unauthorised recording. Do not use Dicted's live-recording feature to capture audio in circumstances where you have not obtained all consents required by the recording laws of your or other participants' jurisdictions. Compliance is your obligation under Terms §6.5. Dicted does not announce its recording status to other participants; if announcement is required by your local law, you must do so manually.
  • Upload illegal content. No child sexual abuse material. No content depicting violence against identifiable persons for the purpose of threat or harassment. No credible threats. No content that infringes third-party copyright, trademark, or patent rights without a licence.
  • Use the Service to harass, defame, dox, or stalk another person.
  • Use the Service to produce output intended to deceive a specific victim into believing something false about a real, identifiable person (e.g., generating fake quotes attributed to someone, or fabricating a transcript of a meeting they did not attend).
  • Use outputs to violate others' privacy — including scraping audio from other services without consent and processing it here to bypass our rate limits.

2.3 Resell, re-brand, or embed

  • Do not resell dicted output as part of another paid product or service without a separate written commercial agreement with us. Taking our transcript output and selling it as "our own transcription service" is not permitted.
  • Do not embed dicted functionality in a third-party product through reverse-engineered APIs or scraped credentials. If you want to build on dicted, talk to us about a partnership ([email protected]).

2.4 Deceive us or other users

  • Do not impersonate another person or organisation when signing up or interacting with our support team.
  • Do not submit false chargebacks or knowingly false consumer-rights claims.
  • Do not use free-trial mechanics (the 7-day Pro taste, future promos) in bad faith — e.g., cycling through fresh email addresses to stack multiple taste periods.

2.5 Upload regulated or professionally-confidential content

Dicted is a general-purpose productivity tool. It is not certified, designed, or marketed for regulated-industry workflows, and it does not hold the contractual or technical posture required to handle several categories of content.

  • Protected Health Information (PHI). Do not use Dicted to capture, transmit, dictate, record, or otherwise process Protected Health Information as defined under HIPAA (45 CFR §160.103) or any equivalent health-information regulation in your jurisdiction (including the Australian Privacy Act 1988 (Cth) APP regime for health information, the My Health Records Act 2012 (Cth), state-level Health Records Acts, EU GDPR Article 9 special-category data, and US state-level health-privacy laws). Dicted is not HIPAA-compliant and does not enter into Business Associate Agreements. This applies whether you are a US Covered Entity, a Business Associate, a healthcare provider outside the US, or any user processing audio from a healthcare setting that identifies a patient. See Terms §5A.2 for the full contractual prohibition and consequences.
  • Privileged legal communications that you are not authorised by your professional-conduct rules to process through a non-certified third-party service. See Terms §5A.3.
  • Therapy and mental-health session content identifying a client. See Terms §5A.4.
  • Regulated financial, audit, or insurance records subject to recording-retention or confidentiality regimes you have not satisfied yourself the Service can support. See Terms §5A.5.

If we become aware that you are using the Service for any of the above — whether through a support ticket, a complaint from a third party, or any other channel — we may suspend your account immediately and require deletion of the offending content under Terms §5.3 and §12. We will not retain content we are not lawfully permitted to hold.

3. Consequences

If we believe you are in breach, we will follow a proportionate response:

  1. Warning — we email you, describe the concern, and give you a chance to explain or change behaviour.
  2. Throttling or feature restriction — we reduce processing priority or limit certain features until the pattern resolves.
  3. Suspension — we lock your account with full data access preserved for export while we investigate, except where the content is unlawful for us to hold or return (see the illegal-content carve-out below).
  4. Termination — for serious, repeated, or criminal breaches (CSAM, fraud, attacks on our systems), we terminate without further notice and report to the relevant authority. Child sexual abuse material (CSAM) we will always report. We are legally required to do so, and we report it to the relevant authorities — in the United States to the National Center for Missing & Exploited Children (NCMEC) under 18 U.S.C. §2258A, and in Australia to the Australian Centre to Counter Child Exploitation (ACCCE) and the eSafety Commissioner — and we cooperate with law enforcement. Report suspected CSAM or other illegal content to [email protected].

Illegal-content carve-out. The data-preservation and export rights described above — and the 30-day export right in Terms of Service §12 — do not apply to content that is unlawful for us to hold or hand back, including CSAM, credible threats, and content subject to a preservation order or an accepted takedown. We preserve such content only for as long as the law requires for reporting and law-enforcement purposes, disclose it only to the relevant authority, and then remove it. No copy is returned or exported to the account holder.

For paying customers, we aim to contact you before a permanent suspension unless the breach is severe or legal action requires immediate intervention.

4. Reporting abuse

If you are affected by a breach of this AUP — for example, you have discovered that a dicted user is processing your voice content without consent, or using the Service to harass you — report it to [email protected]. Include as much evidence as you can safely share. We will investigate and act within 5 business days.

5. Changes to this AUP

Material changes are notified to customers by email at least 30 days before taking effect, in line with our Terms of Service §14.
